1. Introduction

Welcome to Obituaryweb. Obituaryweb is a Kenyan digital platform dedicated to preserving memories and respecting the dignity of the departed by enabling the creation and management of digital obituary profiles.

These Terms of Service ("Terms") govern your access to and use of the Obituaryweb website, applications, and related services (collectively, the "Service"). By accessing or using Obituaryweb, you agree to be bound by these Terms. If you do not agree, you must not use the Service. In these Terms, โ€œweโ€, โ€œusโ€, and โ€œourโ€ refer to Obituaryweb, a service operated in Kenya.

2. Eligibility and User Accounts

  • You must be at least 18 years old to create an account on Obituaryweb.
  • You agree to provide accurate, current, and complete information during registration and to keep your account information up to date.
  • You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.

3. Nature of the Service

Obituaryweb provides tools for:

  • Creating and managing digital obituary profiles;
  • Publishing memorial information submitted by users;
  • Facilitating optional participation in revenue-related activities, such as sales agency arrangements.

Obituaryweb does not verify the factual accuracy of obituary content submitted by users. Responsibility for content rests with the submitting user.

4. Respectful Use and Content Standards

Given the sensitive nature of memorial content, users agree to:

  • Act respectfully toward the deceased, their families, and the community;
  • Avoid defamatory, offensive, misleading, or unlawful content;
  • Ensure that they have appropriate authority or consent to publish information about a deceased person.

We reserve the right to review, moderate, remove, or restrict content that violates these principles or applicable Kenyan law.

5. Fees, Payments, and Transactions

Certain features or services may involve fees:

  • Payments may be facilitated through supported payment methods, including M-Pesa.
  • Obituaryweb does not store M-Pesa numbers, credit card numbers, or other sensitive financial credentials.
  • Payment records contain only a system-generated transaction reference linked to the user account.
  • Payment logs are retained for 30 days solely for reconciliation and audit purposes and are automatically deleted thereafter.

6. Data Protection and Privacy (Kenya)

6.1 Legal Framework

Obituaryweb is committed to protecting personal data in accordance with the Data Protection Act, 2019 of Kenya and the guidance of the Office of the Data Protection Commissioner (ODPC).

6.2 Personal Data We Collect

  • Name and email address โ€“ required for user registration and communication;
  • Telephone number โ€“ collected only when a user opts to participate as a sales agent and selects M-Pesa as a preferred payment method;
  • System-generated transaction references โ€“ for payment tracking (no financial credentials stored).

6.3 Purpose of Processing

  • Account creation and authentication;
  • Service-related communication;
  • Facilitating payments and commissions where applicable;
  • Compliance with legal and audit obligations.

Personal data is not sold, shared, or disclosed to third parties for marketing or unrelated purposes.

6.4 Lawful Basis for Processing

  • User consent;
  • Performance of a contract (providing the Service);
  • Compliance with applicable Kenyan law.

6.5 Data Security

  • User passwords are securely hashed using industry-standard cryptographic methods.
  • Administrators cannot view or retrieve user passwords.
  • Appropriate technical and organisational measures are in place to prevent unauthorised access, loss, or misuse of personal data.

6.6 Data Retention

  • Account data is retained only for as long as the account remains active or as required by law.
  • Payment logs are retained for 30 days and then automatically deleted.

6.7 Data Subject Rights

  • Access personal data held about you;
  • Request correction of inaccurate data;
  • Request deletion of personal data where legally permissible;
  • Object to or restrict certain processing activities.

7. Intellectual Property

All intellectual property rights in the Obituaryweb platform, excluding user-submitted content, belong to Obituaryweb. Users retain ownership of their submitted content but grant Obituaryweb a non-exclusive licence to host, display, and distribute such content as part of the Service.

8. Prohibited Uses

  • Violate any Kenyan law or regulation;
  • Infringe intellectual property or privacy rights;
  • Publish false, misleading, abusive, or harmful content;
  • Attempt to compromise the security or integrity of the platform.

Violation may result in suspension or termination of access.

9. Service Availability and Disclaimer

The Service is provided on an โ€œas isโ€ and โ€œas availableโ€ basis. While we strive for reliability, we do not guarantee uninterrupted or error-free operation.

10. Limitation of Liability

To the maximum extent permitted by Kenyan law, Obituaryweb shall not be liable for indirect, incidental, or consequential losses arising from use of the Service.

11. Termination

You may stop using the Service at any time. We may suspend or terminate access if these Terms are violated or where required by law.

12. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of Kenya, and any disputes shall be subject to the exclusive jurisdiction of Kenyan courts.

13. Changes to These Terms

We may update these Terms from time to time. Continued use of the Service after changes are published constitutes acceptance of the revised Terms.
